Agreement on "By Your Sight"


  1. Organisation- Blindfold Run 2018 – “By Your Sight” is organized by RunGen Company. (hereby known as the Organizer).
  2. The Participants are required to register for the event by completing and submitting the prescribed electronic registration form through the online registration system of the Run Event (‘the e-Registration Form’). By submitting the e-Registration Form, the Participants and/or their parents/guardians are deemed to have given permission to the Organizer to collect, analyse and use the Participants’and/or their parents’/guardians’data and information as the Organizer deems fit. The Organizer shall at all times comply with the prevailing Malaysian laws on personal data.
  3. The e-Registration Form submitted by the Participants will only be processed and validated after confirmation of receipt of the registration fees by the Organizer. Upon confirmation of registration, there will be no refund of the registration fees for any reason whatsoever. For the avoidance of doubt, the registration of any Participant is non-transferable to any other party.
  4. Participants must complete their registration details with true, accurate and current information.
  5. The registration for participant below the age of 18 years (‘the Minor Participant’) shall be submitted by their parent/guardian on behalf of the Minor Participant. The e-Registration Form received by the Organizer shall be the conclusive evidence of the e-Registration Form being completed and submitted by the parent/guardian and not someone else. The parent/guardian must ensure the understanding, observance, compliance and adherence of the Rules and Regulations by the Minor Participant. In the event the Minor Participant and/or the parent/guardian of the Minor Participant fails to do so, the Organiser shall have the absolute discretion to refuse participation of the Run Event by the Minor Participant. For the avoidance of doubt, the parent/guardian shall indemnify the Organiser for its loss or damage due to the breach of any Rule and Regulation by the Minor Participant.
  6. Inaccurate or incomplete information can be grounds for disqualification or barring from the event with no issuance of a refund.
  7. Participants must agree to receive contact from the event Organizer from time to time by email. Any notice sent by email by the organizer or the party so assigned by the Organizer to the supplied address on the registration form shall be deemed received by the Participant.
  8. Confirmation and acceptance of registration will be forwarded via email to the Participants’ email address provided in the e-Registration Form within 7 working days from the date the Organizer received the e-Registration Form.
  9. Transfer of bib registration is not allowed and any substitution of runners must be with the consent of the Organizer and they will not entitled to any prizes nor other entitlement and shall assume any risk at their own expenses.
  10. Waiver for loss.  The Organizer will not be responsible for any loss and/or damage, personal or otherwise, to the belongings and items deposited at the event baggage storage facility and any areas related to the Event.
  11. Baggage deposit The Organizer also reserve the right to check any item or baggage deposited if any suspicious item is found.
  12. The Organizer reserve the right to modify or substitute any of these R&Rs and/or T&Cs from time to time as they deem fit. If there is ambiguity in any of these provisions, the Organizer shall be the authority to interpret and in so doing, they will take into account the interests of all the affected Participants. Any amendments to these R&Rs and/or T&Cs will be updated on the Official Website.
  13. Postpone on situation beyond control. The Organizer reserve the right to cancel or postpone By Your Sight blind-folded walkathon at any time with or without prior notice to the Participant, in which case they will make reasonable effort to inform the Participant prior to the date of the event. If the event has to be postponed, there shall be no refund of fees paid and the Organizer shall not be liable for any other loss or inconvenience caused.
  14. Amendment on routes .The Organizer reserve the right to amend the routes as they deem fit for the safety of the Participant and/or to prevent any potential hazards in the walking of the event, at any time without prior notice to the Participant. In such cases, every effort will be made to inform the Participant prior to the day / date of the event. The Organisers shall not be liable for any other loss or inconvenience caused due to such changes.
  15. Participant’s waiver on safety. Whilst reasonable precaution will be taken by the Organizer to ensure the Participants’ safety, Participants take part in this event at their own risk and the Organizer will not be responsible or held liable for any injury or death howsoever arising from training for or during participation in the event. Participants upon registration hereby waived their rights to take any legal action whether or not contractual or negligence or under any laws or enactment against Organizer for any loss, injury and damage pertaining to their participation in the event.  
  16. Items not allowed Pets, bicycles, in-line skates, prams, push carts, shoes with built-in or attached rollers and any other wheel-run objects are not allowed on the race route for all categories.
  17. Any obstruction or any act of annoyance, destruction or aggression or any such actions against another Participant or against public order are at all times strictly prohibited throughout the event. The Organizer may obtain or seek the intervention of the relevant authorities to ensure the order and safety of the other Participants at the event.
  18. The Participants shall at all times be bound to refrain from carrying out any conduct (which may include the act of using social media) that may cause harm, potential harm or disrepute to the Organizer, any third party or in contravention of any law. The Participants must fully indemnify the Organizer or any third party in respect of such damage or loss incurred or suffered. This para 20 shall survive the expiration of the Run Event for a period of 6 years.
  19. Participants are strictly prohibited and undertake not to bring into, or consume, or possess any illegal substance at the event or carry any arms which include weapons, smoke bombs, compressed gas containers, blades of any kind, or glass bottles. Any Participant who breached this rule shall immediately cease to participate in the Run Event upon request by the Organizer and the Participant may be handed to the relevant authorities for subsequent action. Smoking and vaping of any substances is at all times not permitted at the event.
  20. Where there arises any discrepancy between any published versions of the Rules and Regulations (whether in the form of the hard copy registration forms of the Run Event or in the official website of the Run Event, or such other published formats), the Rules and Regulations of the official website of the Run Event shall supersede all other published versions of the Rules and Regulations for the Run Event.


          Safety & medical

  • Participants are strongly encouraged to consult their medical practitioner prior to registration and before the actual race day.
  • Participants must be physically fit and in good health to complete their chosen race distance within the designated cut off time.
  • Participants are responsible for their own personal health insurance and wellbeing. The event Organizer assume no responsibility for any injury or damage that occurs from training, during or as a result of the event. Participants are encouraged to consult with their medical practitioner prior to the event.
  • Participants must retire from the race immediately if asked / requested to do so by any member of the officials, medical personnel or security officers.


         Participant information

  • By signing up for the event, the Participants agree to grant the Organizer permission to collect, analyse, or distribute any personal information regarding the event as they deem fit, including any races statistics and demographic information to be used for any future planning, data, research, marketing, and/or any other purpose.
  • The Organizer reserve the right to use any photographs, video, sound recordings, personal statements / interviews or any other media from the event as they deem fit, including in future marketing and commercial advertising.
  • If cheat or fraud of personal information, participant will be void and ban from participating this event. **


         Race Entry Pack collection

  • All Participants must collect their race entry pack during the designated Race entry pack collection time period, details of which are on the Venue so stipulated. If Participants are unable to collect their race entry pack in person, another authorized person may do so for them upon informing the Organizer and/or the race registration online company via their email address.
  • Late collection will not be entertained, and the Organizer shall not be liable for any loss or inconvenience caused due to Participants’ inability to collect their Race Kit. It is the sole responsibility of the Participant to collect their Race Kit during the collection period.
  • Uncollected Race Kits will be deemed as unwanted, and the Organizer shall be at liberty to dispose or re-distribute them accordingly. After registration, there will be no fee refund for Participants who do not eventually take part in the event, for any reasons whatsoever.
